Terms and conditions for private hire chauffeur services

Introduction

As prescribed under Regulation 9(14) of the Private Hire Vehicles (London) (Operators’ Licences) Regulations 2000, the operator must enter into a contractual obligation as principal with the person making a private hire booking to provide the journey. In compliance with this regulation, Wilson James Limited provides private hire chauffeur services as set out in these terms and conditions and enters into contractual obligation as principal with the person making a private hire booking to provide the journey.

By booking or using the private hire chauffeur services set out in these terms and conditions, the individual agrees to the following terms:

Agreed terms

Definitions and interpretation

The following terms apply to these terms and conditions:

  • Black Service means the premium service offering provided by Heathrow VIP Services;
  • Booking means a request for Services made through Heathrow VIP Services;
  • Company means Wilson James Limited, a company registered in England and Wales, (registration number 0226956) whose registered address is located at Chalkwell Lawns, 648-656 London Rd, Westcliff On Sea, Essex, SSO 9HR;
  • Drivers means the licensed chauffeurs employed or engaged by the Company to provide the Services;
  • Heathrow VIP Services means the VIP service provided at Heathrow Airport through which Bookings are facilitated;
  • Passenger means any individual who uses the Services, including any accompanying passengers;
  • PHV means private hire vehicle;
  • Services means the private hire chauffeur services provided by the Company to Heathrow VIP Service passengers using Black Service;
  • Terms means these terms and conditions as amended from time to time;
  • TfL means Transport for London;
  • Trading Address means the Company’s trading address, being Windsor Suite, 1st Floor Management Office, Whittle Road, TW6 2GW; and
  • Vehicle means any private hire vehicle licensed by TfL and operated by the Company for the provision of Services.

The Services

The Company is the licensed private hire operator providing chauffeur services exclusively for Heathrow VIP Service passengers using Black Service, licensed by TfL with licence number 6862.

Services are provided solely to Heathrow VIP Service passengers and are complimentary for those using the Black Service. No Bookings are accepted from the general public or any other third-party entities.

The Company shall ensure that all Services provided are in accordance with the following standards:

  • All Vehicles shall be duly licensed, comprehensively insured and maintained in accordance with TfL standards and all applicable regulatory requirements; and
  • All Drivers shall be appropriately licensed, uniformed and shall conduct themselves in a professional manner at all times.

All estimated journey times are approximate only.

Booking requirements

While Bookings may be facilitated through Heathrow VIP Services, the contract for transportation is directly between the Company and the Passenger(s).

Passenger(s) must provide accurate details at Booking. Bookings and Vehicles are subject to availability and confirmation.

The following is the required information from the Passengers to fulfil a Booking:

  • Full Passenger(s) name and contact details;
  • Flight details (number, arrival/departure times, terminal);
  • Pick-up and destination addresses;
  • Number of passengers (maximum four (4) per standard vehicle); and
  • Special requirements (child seats, accessibility needs, excess luggage).

Price

All services are complimentary for Heathrow VIP Service passengers using Black Service. All luggage requirements and allowances are subject to the Black Service.

Cancellations

All cancellations must be made through Heathrow VIP Services.

Passenger Responsibilities

  • Passengers must behave in a responsible and respectful manner towards Drivers and Vehicles.
  • No smoking, vaping, or consumption of alcohol or illegal substances is permitted in the Vehicle.
  • Seat belts must be worn at all times in the Vehicles in accordance with UK law.
  • Passengers must not request the Driver to break traffic laws or TfL regulations.

Voice Contact Requirement

On behalf of the Company, a person will be available for Passengers to speak to during operating hours and throughout any journey being taken.

The Company’s hours of business are 4am – 11pm.

Lost Property

  • Lost property will be stored in a safe place, securely and logged.
  • Passengers may collect lost property from the Trading Address. All details of the property will be logged by the Company for record keeping purposes.
  • At the Passenger’s request, the Company can arrange delivery of lost property using our own Driver and Vehicle, free of charge.
  • Lost property will be held securely for three months. The Company will make reasonable efforts to contact owners. After three months, unclaimed items may be disposed of, with the Company retaining no ownership rights but being released from further storage obligations.
  • Disposal of unclaimed items may be sold to specialist third-party companies.
  • Identity documents (e.g., passports, IDs, credit cards) shall be handed over to the appropriate authorities such as Border Force or airport police.

Liability

Nothing in these Terms will exclude or limit any liability:

  • For death or personal injury caused by negligence;
  • For fraudulent misrepresentation or for any other fraudulent act or omission; and
  • For any warranty implied by law and/or for any other liability which may not lawfully be excluded or limited.

Subject to clause 9.1, the Company shall not be liable or responsible for:

  • Any errors in or failure to provide the Services due to your error or failure to provide accurate and complete information on Booking;
  • Loss or damage to luggage or personal items;
  • Delays caused by traffic, road closures, adverse weather, or circumstances beyond our reasonable control; and
  • Any consequential losses such as missed flights or connections resulting from delays.

Record Keeping

The Company shall maintain detailed booking records including: name of individual responding to booking, name of dispatcher, PHV licence number of Driver and Vehicle, and Vehicle registration mark.

Data Protection

Modifications

The Company keeps these Terms updated and amends them every so often, with Passengers advised to check these Terms before making a Booking.

The Company may modify terms or terminate Services by publishing changes on their website, with Passengers required to stop using Services if they disagree with changes.

Severance

If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the Terms.

Force Majeure

The Company shall not be in breach of these Terms nor liable for the delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from a circumstance not within our reasonable control. In such circumstances we shall be entitled to a reasonable extension of the time for performing such obligations.

Third Party Rights

These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

Governing Law

This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
